The title insurance business in New Mexico is closely regulated by the New Mexico Insurance Department. As a result, all title insurance policy, commitment and endorsement forms and premiums to be charged for them are mandated by the Department and are the same for all title companies in New Mexico. Fees charged by title companies for closing and escrow services are not regulated, and can therefore vary from company to company. However, competition being what it is, closing and escrow fees charged by the different title companies in Bernalillo, Sandoval, Valencia, and Torrance Counties are virtually the same.
